How can lobbying and influence be useful not only for those whoalready are powerful, but also for the empowerment of the disempowered? Thus, how may we democratise control over the means of rhetorical power? An answermay be found in rare cases of social movement communication impacting constitutionalreform, such as the Alta Dam Conflict, 1970–1982, from an area wherethe Norwegian state overlaps with the Sápmi homeland. Social movement communicationas democratic innovation is a research topic scattered between socialmovement studies (SMS) and strategic communication research (SCR). This chapterintegrates both perspectives, firstly, (a) by identifying one shared approach,“empirically grounded Critical Theory”; and secondly, (b) by applying the empiricalmethod typical to that approach, namely “comparative historical analysis”; andthirdly (c) by suggesting some empirically grounded amendments to existing theoreticalconcepts on social movement communication as democratic innovation.

Statens antropologi - perspektiver på landskap.
Fulltekst i vitenarkiv
Vis sammendrag

Beyond state-centred 'realism' - A Gramscian comparison of Sámi and Sardinian political anthropology.
Fulltekst i vitenarkiv
Vis sammendrag
Scientific Marxism can be seen as a form om "state-centred realist" political science, with its sensitivity to the function of coercive force for the creation and preservation of political order. However, it might be over-sensitive to this particular issue, inspiring excessive use of force and securitization in various practical contexts. Gramsci, with his particular experience from Italian internal colonialism in the agropastoral Sardinia, initiated the internal decolonisation of scientific Marxism, with increased empirical sensitivity to moral economy and informal legal order among agrarian subaltern classes. However, for him, legal ordering was still associated with coercive force, from the seizure of state power, to the traditional agropastoral vendetta. These theoretical premises of his are challenged when we apply his theory to the historical anthropological study of indigenous rights struggles in Sámi, an indigenous homeland at the Arctic Fringe of Europe, divided between Norway,Sweden, Finland and Russia. The continuous existence of an indigenous, mainly pastoral, legal order, in spite of the attempts to impose ethnocentric state law, constitutes the basis for UN-recognition as an indigenous people. As the paper shows, the informal laws of Sapmi were maintained, policed and defended with social sanctions alone, whereas the recent political mobilisation for constitutional recognition is an example of successful nonviolent militancy. This indicates, at a theoretical level, that coercive force is no necessary characteristic of all political orders nor of all political revolutions. Thus, the paper argues, the gramscian internal decolonization of scientific Marxism should be further developed in an empirically more realistic direction by rejecting the dogma of "state-centred realism".

Coastal Sapmi – Subsistence Fisheries, Legal Anthropology and Re-constituted State Theory.
Fulltekst i vitenarkiv
Vis sammendrag
This paper demonstrates the power of anthropological participant observation as a tool to uncover actual coexistence of parallel norm systems in the management of land and water resources. Three summers and three winters, I visited subsistence fishers in Coastal Sápmi. The paper also demonstrates the need for anthropologists working in this region to turn from economic anthropology to legal and political anthropology, and thus, to challenge the definitional monopoly of the national political science discipline called “state science”. The fieldwork in Coastal Sápmi started out with concepts and methods from the political science of European integration, but gradually turned to the concepts and methods of political anthropology. This abductive, hypothesis-generative approach was useful to uncover how actual fishing activities in this area might be governed in accordance with multiple strata of parallel social norm systems. Some of these norm systems have been codified in state law, some have been criminalized, while some are simply ignored by the scribes of paper-laws. This research criticizes so-called “state scientists” who operate with the normative assumption that the nation-state is the only possible container of liberal democracy. However, by taking the anthropological approach into the domain of political science, this research also urges anthropologists to be bolder, and not observe Sámi indigenous landscape practices as if these were relatively autonomous from their legal and political context (e.g. Paine 1967, Ingold 1995, Bjerkeli 2000, Berkli 2010). On the contrary, the anthropological gaze can contribute to re-constitution of the theory of political systems and how they are constituted (as with Nustad and Krohn-Hansen 2005). The ongoing re-constitution of state theory is a practical contribution to the ongoing re-constitution of the state system. Regionalization, Europeanization and globalization enable a new gaze on our presumably national past. Recent research has disclosed a continuous usage of natural resources, in accordance with local customs developed from an ancient stateless political system. This indicates that the states Norway, Sweden, Finland and North-West Russia never fully succeeded in their attempt to define themselves as the only legitimate source of law. The actual tension between state law and local custom was never resolved, until the states ratified recent international norms on indigenous human rights, and then started the unfinished process of sorting out the contradictions. The ongoing decolonisation in the Sápmi Region is a process of further democratisation, beyond the systematic racial discrimination previously imposed under four nominally democratic states. An empirical study of further democratisation in the Sápmi Region invites rethinking of our habitual thinking about democratization in Europe, both conceptually and epistemologically.

(Section Chairs) Section S16 Constitutional Complexity - State Theory after the New Political Anthropology.
Fulltekst i vitenarkiv
Vis sammendrag
The purpose of this Section is to bring together political scientists and political anthropologists who are discovering realities outside the box of normative / methodological nationalism and statism.
These two fields have developed in parallel, but in relative isolation from each other. Bringing them together might be mutually beneficial at a moment when populist movements are bringing nationalism back on the stage. We will facilitate empirical and theoretical exchange between political scientists and political anthropologists who inquire into realities that can hardly be framed within the normative / methodological assumptions about culturally homogeneous nations and politically unified states.
Political Science: European integration has led political science and practice to re-think the theory of the state, questioning the normative / methodological nationalism and statism implied in the Westphalian order. The re-thinking of the state has been fuelled by, among other issues, an increased awareness to cultural pluralism, following the reaction against the Holocaust, and the arrival of new ethnic minorities. Institutions and citizenship beyond the nation state have been researched by various researchers at the European University Institute, such as Rainer Bauböck, Olivier Roy and the Migration Policy Centre. However, a return of normative and methodological nationalism might be seen, with the populist political responses to economic crisis.
Political Anthropology: Within political anthropology, a parallel, but separate development has taken place. Following the national independence of former colonies, the former anti-colonialist nation-building has been partly replaced by a post-colonial sensitivity to the complex historical heritage in former colonies. Political anthropologists such as Sharon Hutchinson, Deborah Poole, Knut Nustad and Bruce Kapferer are researching complex sovereignty and legal pluralism not only within “third world” states, but also among indigenous “fourth world” peoples. In particular, the indigenous rights struggle, with its recent developments in international law, has implied a search for proof within legal anthropology. As a result, legal scholars in Latin America have developed constitutional legal theory that transcend the normative / methodological nationalism / statism of the previous legal positivism (see e.g. the work of Marcello Neves and Ugo Mattei). Such research has contributed to the refinement of concepts such as “legal pluralism”, “jurisdictional pluralism” and “complex sovereignty”, which may or may not include the presence of territorially clear-cut monopolies of coercive force. The research on complex social, political and/or military systems imply novel theoretical developments in political anthropology and legal anthropology, with potential consequences for state theory and legal theory in general.
These two research fronts have developed in parallel, yet in relative isolation from each other. Nevertheless, some recent multidisciplinary and comparative research has started to exploit the potential to bring the two research fronts together. For example, recent research on the indigenous Sámi people of Northern Europe has brought together these two strands of research, e.g. in the edited volume Indigenous Politics, published at ECPR Press in 2016. This volume, as well as similar research on the Sámi, indicates that the Nordic states never were capable to impose the ideal of the unitary state/nation in practice, compared to how strongly it was claimed in theory. This is only one example of what might happen when the two strands of research are being brought together.

Studies of indigenous peoples has become one of the fruitful intersections between political science and political anthropology, as well as legal science and legal anthropology. This field of research has grown as a result of the search for proofs, within the ongoing institutionalization of indigenous rights within international law.
The territorial claims by indigenous movements have highlighted the actual co-existance of parallel norm systems regulating the usage of natural resources, in spite of earlier attempts by state-builders to claim jurisdictional monopoly over indigenous lands. At the scholarly level, such empirical realities have actualized recent theoretical developments in various disciplines; on the one hand, political science after the conceptual convinces of "methodological nationalism"; on the other hand, political anthropology after the "island metaphor" of coherent, bounded cultures.
While political scientists have been led re-think the theory of the state, through studies of European political integration and Latin American political movements, the political anthropologists are researching complex sovereignty and legal pluralism in various postcolonial areas. Whereas American political formations have a history of colonization from external forces, there are other indigenous peoples in Eastern Europe and Western Europe, who have experienced a history of internal colonization under the exiting states (e.g. the Nenets in North-West Russia, and the Samis under the Nordic states).
Some recent multidisciplinary and comparative research has started to exploit the potential to bring the two research fronts together. The research on complex social, political and/or military systems imply novel theoretical developments in political anthropology and legal anthropology, with potential consequences for state theory and legal theory in general.
In this panel, we welcome papers about indigenous peoples within and outside Europe, e.g. the Sámi and the Nenet peoples within Europe; or the Mapuche and the Maya peoples outside of Europe.

forskere, til å tenke kritisk over vitenskapens praktiske konsekvenser.
Diagrammene beskriver vekselvirkningen
mellom praktisk yrkesutøvelse og empiriske undersøkelser. Innen
denne sammenhengen
beskriver de metodelære om hvordan man kan
overvinne fordommer (doxa) og stimulere nyskaping – både innenfor
positivistisk og hermeneutisk tradisjon (hhv. Popper og Bourdieu).

This is a study in the art and science of fundamental systems transformation. The study is hypothesis-generative, based upon qualitative research. The cases are selected from one ongoing process of state transformation at the Arctic fringe of Europe. An indigenous rights struggle feeds into the ongoing re-constitution of the body of law. The study contributes to an ongoing re-thinking of concepts and methods in European Political and Social Sciences. The struggle for rights is also a struggle for proofs, which feeds into ongoing re-constitution of the body of knowledge. Positive findings describe my attempts to observe some possible causal mechanisms whereby the indigenous human rights movement has enjoyed some limited success in its effort to decolonize the four states that have divided and conquered Sápmi, the homeland of the Sámi (formerly known as Lapps), the only group within the EU recognized by the UN as an indigenous people. Negative findings describe my attempts to observe some limitations of my own observational capacity. Many questions of relevance to subaltern interest groups remain under-researched and under-documented: There is a great deal of colonial bias that must still be overcome, not only within European political science at large, but also within my own limited contribution, even though I strive to overcome such bias. Seven empirical chapters, discuss two single-case studies: Alta Watershed, ca. 1970-1980, and Deatnu Watershed, ca. 1980-2012. The empirical foundation is qualitative data from field observation and historical archives, which is put ino context with some quantitative data from official registers. The different chapters operate within different disciplines: two are geographical, two are sociological, one is historical, one large one is anthropological, and one should be regarded traditional political science. Although multi-disciplinary, my empirical research continues what I call the major research tradition in the field. This focuses on collective action and social ecology, and informs human rights policies. The theoretical discussion addresses observations by colleagues within another, rival, tradition, which emphasizes coercive force and geo-strategy, and serves public security policies. Transformative social movements need to be aware that both traditions remain limited by a heritage of colonial bias. They also need to be aware that both traditions may be used in a complimentary manner, to help overcoming either fatalism or over-optimism. The thesis concludes that transformative social movements need to avoid the dual pitfalls of naïve idealism and naïve realism, and pursue critical realism.
