Circulars from the Control and Constitutional Committee

[KKU-23.03] Interpretation Regarding Whether the Presidency Can Serve on the Election Board for the Ballot Election When Remaining Members of the Presidency Are Running for Election
Issued on 05.03.2024
Prepared by Iman Salem and Tasia M. Gunar
This circular addresses the question of whether the Presidency can serve on the election board for the ballot election when the remaining members of the Presidency are running for election. The Control and Constitutional Committee (KKU) has determined that the question of whether the remaining members of the Presidency are disqualified when running for election depends on the specific role of the Presidency in the election process.
KKU does not see an issue with members of the Presidency who are candidates for positions where the Presidency serves as the election board, as their role would solely be to operate as a counting committee. Their responsibilities are limited to carrying out neutral and objective tasks, such as counting votes, without influencing the election results. Therefore, they are not considered disqualified.
However, the general rule of impartiality applies to personal elections and other direct elections, cf. § 5-1 (PIK). KKU emphasizes that an elected representative is personally responsible for declaring themselves disqualified if they risk violating the provision in § 5-2, cf. § 5-1 (PIK).
[KKU-23.02] Interpretation Regarding Which Roles in the Local Executive Committee (SRU) Can Hold Dual Positions
Issued on 02.11.2023
Prepared by Iman Salem and Tasia M. Gunar
This circular addresses the question of interpreting who is considered a "member of the Local Executive Committee" as described in § 4-10 of the Principles for Elections and Resignation in StInn (PVF). The regulations generally do not allow dual positions, with certain exceptions mentioned in § 4-10 of the Mandate for Bodies in StInn (MOS).
The Control and Constitutional Committee (KKU) has determined that the term "member of the Local Executive Committee" must be limited to exclude the leader, who has the authority to make recommendations on matters handled by the Student Parliament (ST).
[KKU-23.01] Interpretation of Presence
Issued on 20.09.2023
Prepared by Iman Salem and Tasia M. Gunar
This circular addresses the interpretation of "present" in the rules regarding quorum, cf. Mandate for Bodies in StInn (MOS). The Control and Constitutional Committee (KKU) has concluded that "present" must be distinguished from being merely available. To be considered "present," one must either be physically present or participate via video conference.

[KKU-22.12] Which Positions in StInn One Is Not "Eligible" For After a Vote of No Confidence, cf. PKVM §5-9, Eighth Paragraph
Issued on 30.11.2022
Prepared by Mads Koppang
This circular addresses the question of which positions belong to StInn and therefore fall under the provision in §5-9, eighth paragraph of the Principles for Handling Complaints, Alerts and Motions of No Confidence (PKVM), regarding eligibility after a vote of no confidence against an elected representative.
The Control and Constitutional Committee (KKU) determined that all positions listed in the Mandate for Bodies in StInn (MOS) and the Role Descriptions in StInn (VBS) are part of StInn. After deliberation, KKU also concluded that other positions for which StInn conducts elections or appointments, such as those related to the university's committees, are also considered part of StInn. KKU included a general remark about motions of no confidence at the end of the document.
[KKU-22.11] Sanctions Applicable Following a Vote of No Confidence
Issued on 30.11.2022
Prepared by Mads Koppang
This circular addresses the question of whether the sanctions listed in §5-9 of the Principles for Handling Complaints, Alerts and Motions of No Confidence (PKVM) can also be applied following a vote of no confidence. The Control and Constitutional Committee (KKU) pointed out that the wording of the paragraph specifies that sanctions can be imposed on elected representatives in cases that “do not lead to a vote of no confidence.” KKU noted that a vote of no confidence results in the elected representative losing their mandate, and consequently their benefits and access within StInn. KKU interpreted this to mean that there is no need for additional sanctions, as a vote of no confidence is the most severe sanction within the organization. The intent behind the provision is to have sanctions available for cases where they are warranted but where the misconduct is not severe enough to justify a vote of no confidence. The exception is the sanction regarding ineligibility for positions within the organization for a period in the future, as stated in the provision’s eighth paragraph.
[KKU-22.10] Authority to Supplement Student Parliament Delegates
Issued on 16.11.2022
Prepared by Jørn Luvåsen
This circular addresses the question of whether the Student Parliament (ST) has the authority to supplement Student Parliament Delegates during a Student Parliament meeting. The Control and Constitutional Committee (KKU) referred to regulations that establish that only the Presidency has the authority to supplement delegates to the Student Parliament. However, it is not specified how frequently the Presidency can meet. KKU interpreted this to mean that the Presidency can supplement delegates to the Student Parliament whenever they deem necessary, as long as it is approved with sufficient quorum. KKU also noted that the Leadership Committee (LU) coordinates election periods and the practical aspects of elections. Additionally, candidates must still meet the formal requirements regardless of the timing of the supplementation.
[KKU-22.09] Interpretation Regarding Whether Faculty Council Student Representatives Also Have the Right to Attend, Speak, Propose, and Vote in the Academics and Research Policy Committee (FFPK)
Issued on 07.11.2022
Prepared by Mads Koppang
This circular addresses the question of whether student representatives from the Faculty Councils have the right to attend, speak, propose, and vote in the Academics and Research Policy Committee (FFPK). The Control and Constitutional Committee (KKU) referred to the wording in §7.2.4 of the Mandate for Bodies in StInn (MOS), which explicitly states that student representatives are to be considered part of the committee. KKU therefore interpreted that student representatives are full members of the committee, with all the rights this entails. One consequence of this interpretation is that the participation of these representatives will affect the committee’s quorum.
[KKU-22.08] Interpretation Regarding Whether the President Can Serve as Both President and Head of Delegation
Issued on 31.10.2022
Prepared by Jørn Luvåsen
This circular addresses the question of whether the President of the Student Parliament (ST) can also serve as the Head of Delegation for their delegation. After thorough deliberation, the Control and Constitutional Committee (KKU) concluded that this is not permissible. The regulations generally do not allow dual positions, with certain exceptions outlined in §4-10 of the Mandate for Bodies in StInn (MOS). One consequence of this interpretation is that campuses with only one delegate, who automatically becomes the Head of Delegation for their campus, will not be able to have that delegate also serve as the President of the Student Parliament.
[KKU-22.07] Interpretation of the mandate of the Organizational Committee (OU) in connection with the initial processing of complaints and motions of no confidence
Issued on 12.10.2022
Prepared by Mads Koppang
The circular addresses two questions: 1) how many members of the Organizational Committee (OU) must participate in the processing of a complaint or motion of no confidence for a decision to be made, and 2) whether OU can internally constitute a subcommittee to handle such cases. The Control and Constitutional Committee (KKU) interpreted the first question in relation to the general quorum requirement for the body, stating that at least half of the members with voting rights must participate. Regarding the second question, KKU concluded that OU does not have the authority to appoint a subcommittee. General remarks were also made about the processing of such cases, with references to rules and principles regarding proper case handling and impartiality.
[KKU-22.06] Postponement of the Student Parliament (ST) to later in the autumn
Issued on 07.10.2022
Prepared by Jørn Luvåsen
The circular addresses the question of what is required to postpone a Student Parliament (ST) meeting. The Control and Constitutional Committee (KKU) concludes that, as a rule, a Student Parliament meeting cannot be postponed, as governing documents stipulate a minimum number of meetings within specific periods each calendar year. It was noted, however, that the Student Parliament has the authority to make decisions as they see fit, cf. the Mandate for Bodies in StInn (MOS). The circular explains that this can be achieved by convening an extraordinary meeting (or using a pre-scheduled date) where delegates unanimously vote to postpone the Student Parliament meeting.
[KKU-22.05] The organization's authority to supplement the Election Committee (VK) without an elected Presidency
Issued on 23.09.2022
Prepared by Jørn Luvåsen
The circular addresses the question of the organization's authority to supplement the Election Committee (VK) without an elected Presidency. This is similar to Circular 1 but focuses on the authority to supplement VK. VK is a central position, and it is the Presidency that is responsible for supplementing central positions. The Control and Constitutional Committee (KKU) concluded that the Presidium (SST), with a clear majority, can temporarily appoint a new member to VK until the organization has a functioning Student Parliament (ST). KKU recommended that SST request a recommendation on the candidate from VK.
[KKU-22.04] Use of Rubic or the blind carbon copy (BCC) function when sending internal emails
Issued on 17.09.2022
Prepared by Mads Koppang
The circular addresses the question of whether to use Rubic or the blind carbon copy (BCC) function when sending meeting invitations for a Student Council meeting at local campuses. This is not explicitly regulated by StInn’s governing documents or routines, but the practice in the previous StInn model has been to use Rubic. Additionally, the General Data Protection Regulation (GDPR) must be adhered to. The Control and Constitutional Committee (KKU) recommends using Rubic for the distribution of agenda documents for Student Council meetings to ensure privacy compliance.
[KKU-22.03] Quorum and voting rights in the Student Councils
Issued on 13.09.2022
Prepared by Mads Koppang
The circular addresses the questions of who has voting rights in the Student Council and when the Student Council has quorum. Members of the Student Council consist of all class representatives affiliated with the campus. The quorum for the Student Council is regulated by §4.3.5 of the Mandate for Bodies in StInn (MOS), and the Control and Constitutional Committee (KKU) provides two mathematical examples to make the quorum requirement for the Student Councils easier to understand. The principle is a minimum of half.
[KKU-22.02] Authority regarding the establishment of cooperation agreements
Issued on 22.08.2022
Prepared by Jørn Luvåsen
The circular addresses the question of who has the authority to establish cooperation agreements with external parties. The question came from a Local Executive Committee (SRU) regarding whether the SRU (specifically the leader) has the authority to enter into agreements to secure sponsorships, such as gift cards for stands and presentations.
In the circular, the Control and Constitutional Committee (KKU) explains that the leader (and deputy leader) of the Presidium (SST) has the authority to enter into cooperation agreements on behalf of StInn. The Student Parliament (ST) and the Presidium decide who to collaborate with, but the Presidium determines the content of the cooperation agreements.
KKU encourages SRUs to make use of their approved financial scope of action.
[KKU-22.01] The Presidium's (SST) election authority without a functioning Student Parliament (ST)
Issued on 11.08.2022
Prepared by Mads Koppang
The circular addresses a question from the Presidium (SST) regarding who has the authority to elect individuals to central positions when a Student Parliament (ST) has not been established. The Control and Constitutional Committee (KKU) concluded that this was an extraordinary situation due to the new organizational structure and the absence of an elected President, which meant that the Presidency had not been constituted.
Normally, it is the Presidency that supplements central positions. However, based on this situation, KKU determined that the Presidium, with a clear majority, can temporarily elect a person until the organization has a functioning Student Parliament.
